These Terms & Conditions ("Terms") govern your access to and use of the Gems Harbor website, mobile applications, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.
1. About Gems Harbor
Gems Harbor is an online marketplace that connects buyers and sellers of gemstones. Gems Harbor provides the Platform to facilitate listings, communication, and transactions but is not a party to transactions between buyers and sellers.
We do not guarantee the quality, authenticity, legality, or delivery of any item listed by users.
2. Eligibility & Acceptance
- You must be at least 18 years old to use the Platform.
- By creating an account, you confirm that all information provided is accurate and complete.
- You agree to comply with these Terms, our Privacy Policy, and all applicable laws.
3. User Accounts
To access certain features, you must create an account.
You agree to:
- Maintain the confidentiality of your login credentials
- Be responsible for all activities under your account
- Not create multiple accounts to bypass restrictions
- Notify Gems Harbor of unauthorized access immediately
Gems Harbor reserves the right to suspend or terminate accounts that violate these Terms.
4. Buyer Terms
Buyers agree to:
- Pay the full purchase amount, including applicable fees and taxes
- Review listings carefully before purchasing
- Complete transactions in good faith
- Avoid fraudulent disputes or chargebacks
- Provide accurate delivery information
Gems Harbor does not verify gemstone authenticity and is not responsible for buyer-seller disputes.
5. Seller Terms
Sellers agree to:
- List only genuine gemstones with accurate descriptions and images
- Comply with all applicable laws and regulations
- Fulfill orders as described and within stated timelines
- Pay all applicable subscription, listing, and commission fees
- Resolve buyer issues professionally
Misrepresentation, fraud, or repeated disputes may result in listing removal, suspension, or permanent account termination.
6. Fees & Payments
Sellers may be subject to:
- Subscription fees
- Listing fees
- Commission on successful sales
- Third-party payment processing fees
All fees are non-refundable unless explicitly stated. Fees may be updated with prior notice.
7. User-Generated Content (UGC)
The Platform allows users to create and share content, including but not limited to:
- Listings and descriptions
- Messages, chats, and comments
- Reviews and profile content
- Uploaded images or media
Gems Harbor has zero tolerance for objectionable content, including:
- Hate speech or discrimination
- Harassment, bullying, or threats
- Sexually explicit or pornographic material
- Violence or promotion of harm
- Child exploitation or abuse
- Illegal, deceptive, or fraudulent activity
- Spam or misleading content
Violations may result in immediate content removal and account suspension or permanent ban.
8. Content Moderation & Enforcement
To maintain a safe platform:
- Content may be reviewed automatically or manually
- Gems Harbor may remove content at its discretion
- Users may be restricted, suspended, or banned without prior notice
⏱ Reported content is reviewed and acted upon within 24 hours.
9. Reporting Objectionable Content
Users may report content that violates these Terms using in-app reporting tools.
Reports may include:
- Abuse or harassment
- Inappropriate or explicit content
- Spam or fraud
- Policy violations
All reports are logged and reviewed by the moderation team.
10. Blocking Users
Users may block other users at any time.
When blocking occurs:
- Interaction between users is disabled
- Blocked users' content is hidden immediately
- The action may be reviewed by Gems Harbor moderators
11. Prohibited Activities
Users must not:
- Post fake, counterfeit, or misleading listings
- Manipulate prices, bids, or reviews
- Harass, threaten, or abuse others
- Upload malware or harmful code
- Circumvent platform safeguards
- Violate intellectual property rights
- Use unauthorized automated tools
Violations may result in immediate enforcement action.
12. Intellectual Property
All Platform content, trademarks, logos, and software are owned by Gems Harbor or its licensors.
Users retain ownership of their content but grant Gems Harbor a worldwide, non-exclusive license to use, display, and distribute such content for platform operation and promotion.
13. Disputes & Resolution
Buyers and sellers are encouraged to resolve disputes directly.
Gems Harbor may assist but is not obligated to mediate. We may withhold funds or restrict accounts to protect platform integrity.
14. Limitation of Liability
The Platform is provided "as is" without warranties.
To the maximum extent permitted by law:
- Gems Harbor is not liable for user transactions
- We are not responsible for content accuracy or delivery
- Total liability is limited to fees paid in the preceding 12 months
15. Indemnification
You agree to indemnify and hold harmless Gems Harbor from claims arising from:
- Your use of the Platform
- Violations of these Terms
- Content you submit or actions you take
16. Termination
- Users may close accounts at any time
- Gems Harbor may suspend or terminate accounts for violations
- Outstanding obligations survive termination
17. Changes to Terms
Gems Harbor may update these Terms periodically. Continued use of the Platform constitutes acceptance of the updated Terms.
18. Governing Law
These Terms are governed by the laws of the jurisdiction in which Gems Harbor operates, without regard to conflict-of-law principles.
